The NY State Attorney General’s Office said it gave Rochester’s City Corporation Counsel no instructions to withhold details on the death of Daniel Prude.

Earlier this week, Mayor Lovely Warren said the delay in the release of information on Prude’s death stemmed from an Executive Order related to the attorney general investigating all in-custody deaths in New York.

Friday, a spokesperson for Attorney General Letitia James released the following statement:

“There was never a request from the Attorney General’s Office to the city of Rochester Corporation Counsel to withhold information about the events surrounding the death of Daniel Prude, plain and simple. Once again, the city of Rochester and the Rochester Police Department are free to move forward with their own investigation.”

During a news conference Friday, City Corporation Counsel Tim Curtin said a city attorney reached out to the local deputy attorney general regarding the Prude case on June 4 – specifically in regard to a FOIL request from an attorney representing one of Prude’s family members.

In the conversations that followed, according to Curtin, the city was told the Attorney General’s Office prefers materials not be released to the public due to potential interference with investigations.

“We decided, while the investigation was still pending, that we would wait for the investigation to be completed before we took any action in terms of internal discipline or any action respecting the matter of Mr. Prude’s passing,” said Curtin.

It wasn’t until August 4, Warren said Thursday, that she was made aware of the full scope of circumstances surrounding Prude’s death.

On August 12, Curtin says body camera footage was released to the plaintiff’s attorneys.
